Dobbs Sentences #225: Part III

As always, you can find the Dobbs v. Jackson decision here.

Paragraph 7 of 8

Sentence 1 of 3

This sentence contains two claims:

“No Justice of this Court has ever argued that the Court should never overrule a constitutional decision, but overruling a precedent is a serious matter.”

The claims:

  • “No Justice of this Court has ever argued that the Court should never overrule a constitutional decision.”
  • “[O]verruling a precedent is a serious matter.”

The first claim is essentially impossible to lock down as true, as confirming an absence is still a problem, so that will remain undetermined. The second claim a subjective judgment, but one that is uncontroversial. I’m comfortable calling it true, but I’m willing to hear arguments to the contrary.

One undetermined claim:

  • “No Justice of this Court has ever argued that the Court should never overrule a constitutional decision.”

And one true claim:

  • “[O]verruling a precedent is a serious matter.”
