This section closes with a sentence containing two claims:
“They have failed to make that showing, and we thus return the power to weigh those arguments to the people and their elected representatives.”
The claims:

I don’t know that this has been established even within what has been argued to this point, but we also have quite a bit of argument to go. This is undetermined.
The second claim:
- “[W]e thus return the power to weigh those arguments to the people and their elected representatives.”
The Court definitely made it possible for the States to regulate abortion as they wish, so this is true. Some of the language is loaded, but that doesn’t change the basic truth of the claim.
So this claim is undetermined:
- “[Supporters of Roe and Casey] have failed to make that showing.”
And this claim is true:
- “[W]e thus return the power to weigh those arguments to the people and their elected representatives.”
