Dobbs Sentences #58: Part II B 2 a

As always, you can find the Dobbs v. Jackson decision here.

Paragraph 3 of 8

Sentence 1 of 3

The next sentence indicates another pair of books that don’t lend themselves to easy access:

“English cases dating all the way back to the 13th century corroborate the treatises’ statements that abortion was a crime. See generally J. Dellapenna, Dispelling the Myths of Abortion History 126, and n. 16, 134–142, 188–194, and nn. 84–86 (2006) (Dellapenna); J. Keown, Abortion, Doctors and the Law 3–12 (1988) (Keown).”

Again, the claim is a simple one:

“English cases dating all the way back to the 13th century corroborate the treatises’ statements that abortion was a crime.”

But the sources will take some effort to find and check:

  • See generally J. Dellapenna, Dispelling the Myths of Abortion History 126, and n. 16, 134–142, 188–194, and nn. 84–86 (2006) (Dellapenna);
  • J. Keown, Abortion, Doctors and the Law 3–12 (1988) (Keown).

So this is also undetermined for now.
