Dobbs #4: The Structure of Part I

Part I of the Dobbs decision is short and simple. It’s only four paragraphs long, beginning on page 6 and ending on page 8. It serves as a kind of secondary introduction, giving further information about Mississippi’s Gestational Age Act and what led to SCOTUS granting certiorari.

The first paragraph introduces Mississippi’s Gestational Age Act.

The second paragraph explains how Mississippi’s legislature presents claims to support the act’s legitimacy.

The third paragraph discusses Jackson Women’s Health Organization’s suit and one of the claims they make in support of it.

The fourth paragraph explains why SCOTUS granted certiorari: to address the question of whether “all pre-viability prohibitions on elective abortions are unconstitutional.”

To this point there’s been no reason to dissect the claims in these sections. The argument begins in Part II, so after laying out the structure of that section I’ll get into the deep examination.
